Agreement to Terms

By accessing or using Komilion's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. These terms apply to all users, including developers integrating our API, and visitors of our website.

Service Description

Komilion provides an intelligent LLM routing and API service that routes requests to multiple providers (OpenAI, Anthropic, Google, etc.), offers task-based model recommendations, API health monitoring, and prepaid wallet billing. We act as an intermediary and do not own or control the underlying models or their outputs.

Account Registration

To use our services, you must be at least 18 years old, provide accurate registration information, maintain account security, and notify us of unauthorized access.

Pricing and Payments

We operate a prepaid wallet system with a 25% markup on base provider costs. Payments are processed via Stripe. Wallet credits are non-refundable except in cases of billing errors or technical issues, reviewed at our discretion.

Acceptable Use Policy

You agree not to use our services to:

  • Violate any laws, regulations, or third-party rights
  • Generate illegal, harmful, abusive, or fraudulent content
  • Attempt to circumvent usage limits or billing mechanisms
  • Reverse engineer or extract proprietary algorithms
  • Resell or redistribute services without authorization
  • Abuse or overload infrastructure with automated systems
  • Infringe on intellectual property rights or spread misinformation

Violations may result in immediate account suspension or termination without refund.

Intellectual Property

All content, features, and functionality of our service, including but not limited to text, graphics, logos, icons, images, software, and the selection and arrangement thereof, are the exclusive property of Komilion or its licensors.

  • You retain ownership of content you submit through our service
  • You grant us a license to process your content to provide services
  • AI-generated outputs belong to you, subject to underlying model licenses
  • Our API, algorithms, and documentation are proprietary

Service Availability

We strive for high availability but do not guarantee uninterrupted service:

  • We provide the service on an "as is" and "as available" basis
  • Scheduled maintenance will be announced in advance when possible
  • Third-party LLM provider outages may affect our service
  • We implement automatic failover to minimize disruptions

Limitation of Liability

To the maximum extent permitted by law, Komilion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim. We are not responsible for the accuracy, reliability, or quality of AI-generated outputs.

Indemnification

You agree to indemnify and hold harmless Komilion, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, your violation of these terms, or your violation of any rights of a third party.

Termination

Either party may terminate this agreement:

  • You may close your account at any time through your dashboard
  • We may suspend or terminate accounts that violate these terms
  • Upon termination, your access to the service will cease immediately
  • Wallet credits are non-refundable upon voluntary termination
  • Provisions that should survive termination will remain in effect

Governing Law & Disputes

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through a prominent notice on our website at least 30 days before they take effect. Your continued use of the service after changes become effective constitutes acceptance of the modified terms.
